Ray P. Wimberley, practicing in Hawaii since 1987, works with condominium, homeowner and community associations. Additionally, his work includes litigation concerning prosecuting claims on behalf of said associations, and defending a variety of matters including commercial, real property, and construction cases. His experience includes bench trials, appeals, private arbitration, mediations and administration hearings. He advises clients regarding business transactions and real property and construction matters.
Condominium and Community Associations. For over two decades, Mr. Wimberley has represented several associations. His work includes advising on governing documents, compliance with state and federal law, policy-making, opinion letters, prosecuting claims to enforce governing documents and collections. He further assists associations with real property and construction issues. He assists association clients simplify their operations by standardizing procedures, revising governing documents and reviewing insurance coverage and contracts.
After clerking for Honorable E. John McConnell, Judge, Second Circuit Court, State of Hawaii, Mr. Wimberley joined Rush Moore Craven Sutton Morry & Beh, and eventually became a partner in 1994. In 2004, he opened his own firm dedicating his time to the condominium and community association practice.
His clients range from associations consisting of single-family homes to condominiums to planned developments.
Real Estate and Business Transactions. Mr. Wimberley has performed transactional and non-litigation work for owners, developers, sellers and buyers of commercial and residential properties, and handled the purchase and sale of businesses.
Construction. He has litigated significant construction defect cases, while representing owners, contractors, subcontractors and suppliers. His litigation has included defect claims relating to concrete spalling, windows, and code violations. He further advises association clients regarding handling construction defects.
Arbitration/Mediation. In addition to litigation, Mr. Wimberley has engaged in successful mediation and arbitration on behalf of clients.
